According to the decision, Neruda's death certificate will be examined, as well as test results conducted by foreign institutions.
Neruda's nephew Rodolfo Reyes applied to the court in December 2023 to reopen the case and investigate causes of death other than cancer, but received a negative response.
Reyes claimed that foreign forensic experts had found evidence that Neruda had been poisoned.

Neruda had requested asylum in Mexico 3 days before his death.
The poet's former driver Manuel Araya had claimed that Neruda was poisoned by the secret service.
In a statement made in 2017, a panel of international forensic experts stated that a pathogenic bacterium was found in Neruda's remains, which were exhumed and examined by a judge's order in 2013, and that this bacterium probably caused his death.
The statement said that as a result of the tests, the death certificate did not reflect Neruda's "true cause of death".
