According to BBC, the Constitutional Court ruled by 5 votes to 4 that Article 92-6 of the military penal code, which bans "homosexual intercourse" in the army, is constitutional.

The ruling noted that "homosexual intercourse" in the army could harm soldiers' discipline and combat readiness.

The military penal code stipulates a prison sentence of up to two years for violating the ban.

Activists condemned the decision on the grounds that it would discriminate against "gay" soldiers and could increase violence against them.

South Korea has compulsory military service for healthy men between the ages of 18 and 28, lasting up to 20 months.
